Nakheel home modification NOC

The short answer

Nakheel says owners can make changes that do not affect the external facade or structure of their property, but must first get a No Objection Certificate from Nakheel's Urban Planning team. Request it through Nakheel Online Services or the My Nakheel app. Nakheel treats construction, modification and extension work as needing both a Nakheel NOC and a Trakhees NOC before contractors can get site access.

When you need a Nakheel NOC

Nakheel's customer FAQ says you can make changes to your property as long as they do not affect its external facade and structure, and that you must obtain a NOC from Nakheel's Urban Planning team before making any alterations.

The same FAQ groups construction, modification and extension work as work that needs an NOC from both Nakheel and Trakhees. Contractors cannot get a long-term access permit for that work without both NOCs.

This applies in Nakheel communities such as Palm Jumeirah, Jumeirah Park, Jumeirah Islands, Jumeirah Village Circle, Jumeirah Village Triangle, Al Furjan and Discovery Gardens. Nakheel's community management page now leads to Dubai Holding Community Management, which lists these as Nakheel communities it manages.

How to apply

  1. Read your community rules and decide the scope of work. If it touches the facade or structure, ask Nakheel before you design anything.
  2. Have a Trakhees-accredited consultant prepare the drawings if the work needs a permit.
  3. Request the modification NOC through Nakheel Online Services on the Nakheel website, or in the My Nakheel app.
  4. Once Nakheel issues its NOC, your consultant applies to Trakhees for a Modification Permit through Trakhees online services.
  5. Your contractor applies to Nakheel for a long-term access permit, using the Nakheel and Trakhees NOCs.
  6. Build to the approved drawings and community work timings, then apply to Trakhees for the Modification Completion Certificate.

Typical documents

Nakheel's FAQ does not publish a document checklist for the modification NOC itself. These lists are published:

  • Trakhees Modification Permit: the application form for your type of work, with the latest Trakhees-stamped drawings of the property. If Trakhees has no copy of those drawings, the consultant or contractor prepares "As Existing" drawings, stamped and signed.
  • Contractor access permit from Nakheel for construction, modification and extension work: the scope of work, a valid Nakheel and Trakhees NOC, the company trade licence, the visa or Emirates ID of each worker, and payment confirmation for each worker. A subcontractor also needs its licence and an appointment letter from the main contractor.

Fees and deposits

  • Nakheel modification NOC: no fee is published in Nakheel's FAQ. Ask Nakheel for a quote before you plan your budget.
  • Contractor access permits: Nakheel charges AED 52.50 per person for work that needs a Nakheel and Trakhees NOC.
  • Trakhees Modification Permit: Trakhees says service fees are set per project. Its procedure refers to a contractor's refundable deposit, which is refunded if the permit is cancelled before work starts on site. It may also ask the contractor for contractor's all risks (CAR) insurance.

The Trakhees permit

Trakhees, part of Dubai's Ports, Customs and Free Zone Corporation, is the permit authority for Nakheel areas. Its procedure says any modification or fit-out work in a completed building with a Building Completion Certificate in its area needs a Modification Permit before work starts. Key points from its procedure (revision 2, September 2024):

  • Applications are made online. The helpdesk can reject a submission that is not complete against the checklist.
  • The target time for a new permit is 7 working days from payment.
  • The permit must be revalidated if work has not started within six months.
  • After the work, you apply for a Modification Completion Certificate.

Both the consultant and the contractor working in Trakhees areas must be Trakhees-accredited.

What is restricted

  • Changes must not affect the external facade or structure, according to Nakheel's FAQ.
  • Dubai Holding Community Management asks residents to maintain the community's appearance and not make unauthorised exterior alterations.
  • Contractors must follow community work timings and rules. Nakheel says misuse of access permits or community violations lead to security action.
  • Gulf News reported in 2018 that Nakheel assessed villa modifications case by case, would not let owners in service-charge arrears modify their villas, and limited pergolas, canopies and gazebos in Jumeirah Village to 15 sq m. These are older reports: check the current rules with Nakheel.
